Clear terms for custom work.

These terms explain how website use, quotations, made to measure work, repairs, payment, consumer rights and personal information are handled.

1. Using this website

Website terms

By using the Canvasland website you agree to use it lawfully and in a way that does not interfere with the website, its security, its content or other users. Website information is provided in good faith and may be updated as products, materials, prices, availability and services change.

Images are illustrative of Canvasland work. Because much of the work is bespoke, an image does not mean that an identical item, material, colour or specification is available. A binding order arises only when the applicable quotation or order terms have been accepted and any required deposit or payment has been received.

2. Quotes & orders

Your quotation becomes part of the agreement.

Custom work needs a clear shared brief. The quotation should record the agreed product, dimensions, material, price, payment terms and expected timing.

  • Quotations are valid for the period stated on the quotation.
  • Prices, VAT status, delivery or collection costs and any other charges will be set out on the quotation.
  • Changes requested after acceptance may change the price and completion date.
  • Canvasland will not knowingly charge above an agreed estimate for additional work without first explaining the additional estimated cost and obtaining authorisation where required by law.
3. Bespoke & made to measure goods

Many Canvasland products are made specifically for one customer.

A cover, bag, blind, mat or other item created or altered to a customer’s dimensions or requirements may qualify as special order or personalised goods under South African consumer law.

Measurements

If the customer supplies measurements, those dimensions form part of the brief. If Canvasland measures the item or site, the quotation should record this. Any uncertainty should be resolved before materials are cut.

Colours & materials

Screen colours and photographs can vary. Material batches may also vary slightly. Where exact colour or performance is important, this should be agreed before manufacture.

Custom changes

Once material has been procured, cut, stitched, welded or otherwise altered for the order, changes may involve additional cost and may not always be possible.

4. Deposits, payment & cancellation

Fair terms, made clear before work begins.

Any deposit, balance date or staged payment will be stated on the quotation. Canvasland will not rely on these terms to remove rights that cannot lawfully be excluded.

Because many Canvasland products are made to the customer’s specifications, the ordinary cancellation or cooling off rights that apply to some transactions may not apply in the same way to made to measure or clearly personalised goods. This is recognised in both the Consumer Protection Act and the Electronic Communications and Transactions Act.

If a customer wishes to cancel, Canvasland should be contacted as soon as possible. Any amount that may lawfully be retained or charged will be determined by the stage of the work, materials already committed, the nature of the order, the quotation and applicable South African law.

Nothing in these terms limits a customer’s statutory rights where goods are defective, unsafe, not of the agreed quality, or do not conform to the agreed specification.

5. Production, collection & delivery

Timing depends on the job.

Lead times

Estimated completion times are communicated with the quotation or order. Bespoke work may be affected by material availability, site access, weather dependent fitting, customer changes or other factors outside reasonable control.

Collection

Customers will be told when an order is ready for collection. Any storage arrangements for goods left for an extended period should be agreed separately.

Delivery

If Canvasland arranges delivery or fitting, the destination, charge and practical requirements should be agreed beforehand. Statutory delivery rights remain unaffected.

6. Repairs & customer supplied items

Repair starts with the condition of what already exists.

For repair or alteration work, Canvasland will work with the item in the condition in which it is supplied. Existing fabric, foam, stitching, frames, fittings or components may have age related wear or hidden deterioration that only becomes apparent once work begins.

If additional deterioration is discovered and the agreed repair needs to change materially, Canvasland will contact the customer before carrying out significant additional chargeable work.

7. Quality, defects & consumer rights

Your legal rights remain in place.

The Consumer Protection Act provides consumers with rights to goods that are reasonably suitable, of good quality, in good working order, free from defects and reasonably durable in the circumstances.

Where the Consumer Protection Act applies, its implied warranty of quality and other statutory remedies apply in addition to these terms. Canvasland should be contacted promptly if a customer believes an item is defective or does not conform to the agreed specification.

Normal wear, misuse, unauthorised alterations, accidental damage, use contrary to care instructions, or damage caused after the product has left Canvasland’s control may affect whether a particular issue is a manufacturing defect.

8. Electronic enquiries & transactions

Online communication is part of the customer journey.

The website may be used to submit quote requests, contact details, project information, photographs and other electronic communications. Where an electronic transaction is concluded, the Electronic Communications and Transactions Act 25 of 2002 applies together with other applicable South African law.

Before a binding electronic order is concluded, customers should have a reasonable opportunity to review the transaction, correct mistakes and understand the applicable price, terms, delivery arrangements and return or cancellation position.

9. Privacy & POPIA

Personal information is used for a clear purpose.

Canvasland processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 and applicable regulations.

What may be collected

Name, contact details, delivery or site information, business details, project descriptions, photographs, measurements, correspondence and transaction information.

Why it is used

To respond to enquiries, prepare quotations, enter into and perform contracts, manufacture or repair goods, arrange delivery or fitting, keep appropriate business records and comply with legal obligations.

How it is protected

Reasonable technical and organisational safeguards should be used to protect personal information against loss, unauthorised access, misuse or disclosure.

Personal information will be retained only for as long as reasonably necessary for the purpose for which it was collected, contractual and warranty needs, dispute resolution, legitimate business records and applicable legal retention requirements.

Where service providers process information for Canvasland, appropriate safeguards should be used. Cross border processing or storage, if any, will be handled in accordance with POPIA.

Electronic direct marketing will be handled in accordance with POPIA and applicable law, including appropriate consent or other lawful basis and an ability to opt out.

Subject to applicable law, a data subject may request access to or correction of personal information, object to certain processing, or request deletion where there is no lawful basis for continued retention. Requests should be directed to the Information Officer / privacy contact listed above.

A person may also lodge a complaint with the Information Regulator of South Africa. The website should maintain a separate Privacy Policy explaining these practices in greater detail.

10. Intellectual property

The Canvasland name, photographs and designs remain protected.

Website text, branding, photographs, graphics, patterns, drawings and original design work may be protected by copyright, trade mark and other intellectual property rights.

No website content may be reproduced commercially without appropriate permission. Customers remain responsible for ensuring that any logo, artwork, wording or other material they ask Canvasland to reproduce can lawfully be used.

Canvasland may request permission to photograph completed work for its portfolio or marketing. Identifiable customer information or private locations should not be published without appropriate authority or consent.

11. Liability & events outside reasonable control

These terms do not exclude liability that cannot lawfully be excluded.

To the fullest extent permitted by South African law, Canvasland is not responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. Nothing in these terms excludes or limits liability, warranties, remedies or consumer rights that may not lawfully be excluded or limited.

Canvasland will not be treated as in breach for a delay caused by events genuinely outside its reasonable control, provided reasonable steps are taken to communicate with the customer and resume performance when reasonably possible.

12. Questions, complaints & disputes

Start by talking to us.

If there is a concern about an order, please contact Canvasland promptly with the order or quotation details and photographs where relevant. The aim is to understand the concern and resolve it fairly.

Nothing in these terms prevents a consumer from referring a matter to an appropriate ombud, regulator, tribunal or court where South African law provides that right.

These terms and any agreement with Canvasland are governed by the laws of the Republic of South Africa. Subject to any consumer right to choose another competent forum, disputes may be dealt with by the courts with appropriate jurisdiction in the Western Cape.

13. Changes to these terms

Keep the published version current.

Canvasland may update these website terms when the business, website, services or applicable law changes. The version applying to a particular order is the version incorporated into or made available with that order or agreement.
